Migavibe is a free platform connecting singles for user-organized meetup events (e.g., social gatherings, walks).

What We Do:

  • Provide tools to list/confirm attendance at free events.
  • Review/approve Event Organizers to the best of our ability.

What We Don’t Do:

  • Organize events, process payments, verify users beyond basic checks, monitor meetups, or guarantee safety/results.

Key Risks:

  • All events are user-managed. You assume risks of offline interactions (injury, fraud, etc.).
  • Data: We collect emails/profiles for platform use and optional marketing (unsubscribe anytime). Data retained indefinitely for legitimate purposes unless deletion is requested.

Your Role:

  • Act safely and legally.
  • Follow laws.
  • Limit events to 10 people max (no speed-dating).

1. Introduction

Welcome to Migavibe, a platform designed specifically for heterosexual singles looking to connect through user-organized events.

Our Platform Family: We operate sister platforms for other communities:

While Migavibe focuses on heterosexual dating, all users are welcome to use the platform that best fits their preferences. We encourage you to choose the community where you feel most comfortable.

These Terms of Service govern your use of our free platform for connecting users interested in singles events.

Important Note: Migavibe is only a technological platform. We do not organize, host, manage, or supervise events. All events are created and managed independently by approved users ("Event Organizers"). We are not responsible for offline interactions or user behavior.

If you disagree with these terms, do not use Migavibe.

2. Definitions

  • "We," "Our," "Platform": Migamor GmbH and Migavibe.
  • "You," "User": Any person using the Platform.
  • "Event Organizer": Users we review/approve to list events.
  • "Content": Text, photos, profiles, event listings you submit.
  • "Services": All Platform features (event listings, RSVP, messaging, profiles).

3. Nature of the Service – Platform Only

We connect users. You manage all event logistics, safety, and compliance at your own risk. Events are free; no payments via the Platform.

Event Size Restrictions:

  • Maximum 10 participants per event (including organizer).
  • Speed-dating events are strictly prohibited on Migavibe.
  • Violations result in immediate event removal and possible account termination.
  • For larger or speed-dating events, visit www.migamor.com for professional services.

4. Safety and User Responsibilities

Events carry risks (injury, harassment, etc.). Our review of organizers is limited to basic checks—no guarantees of fitness, background verification, or event quality.

Safety Tips (No Guarantees):

  • Meet in public places.
  • Share your location/plans with a friend.
  • Report issues via the Platform or local authorities.
  • Trust your instincts—leave if uncomfortable.
  • Only attend events with 10 people max.
  • You are responsible for your safety.

5. Data Collection, Use, and Retention

We collect basic information (email, profile, usage data) for:

  • Platform operation
  • Fraud prevention
  • Analytics
  • Optional marketing (opt-out anytime).

Marketing Communications:

  • Optional at sign-up.
  • Includes emails/SMS/push notifications from Migamor GmbH and affiliates about dating products/events.
  • Unsubscribe anytime via link or account settings.

Data Retention:

  • Retained indefinitely for legitimate business purposes (fraud prevention, legal obligations, analytics).

6. Event Organizers

Event Organizers are users we review and approve to the best of our ability (e.g., basic profile check). Approval is discretionary and revocable at any time without notice or compensation.

Organizer Requirements:

  • Event Size Limit: Max 10 participants (including yourself).
  • Prohibited Events: No speed-dating on Migavibe.
  • Free Events Only: No paid events or ticket sales via the Platform.
  • Must comply with all applicable laws and venue regulations.
  • Responsible for all event logistics, safety, and liability.
  • Fair Play Requirement: Organizers must treat all participants equally regardless of gender, sexual orientation, or other protected characteristics. This includes:
    • Accepting/rejecting RSVPs based only on objective criteria (e.g., event capacity, age requirements).
    • No discrimination against participants of the same gender as the organizer.
    • Maintaining professional and respectful behavior with all participants.
  • Violations may result in immediate removal of organizer status.

We occasionally host "Official Migavibe Events" under the same rules.

No Guarantees: We do not vouch for organizer reliability. Organizers must comply with Platform rules; violations result in removal.

7. User Conduct and Prohibited Activities

You agree NOT to:

  • Harass, abuse, stalk, threaten, or harm others.
  • Post illegal, fraudulent, defamatory, obscene, or rights-infringing Content.
  • Impersonate others or misrepresent your identity/age.
  • Spam, scrape data, or reverse-engineer the Platform.
  • Violate laws (data protection, safety, discrimination, etc.).
  • Charge for events or collect payments via the Platform.
  • Organize events exceeding 10 participants.
  • Organize or promote speed-dating events.
  • Discriminate against participants based on protected characteristics.

Consequences: Account suspension/termination, legal action, reporting to authorities.

8. Content Ownership and License

Your Content: You retain ownership. You grant us a worldwide, royalty-free, perpetual license to use, display, modify, and distribute it for Platform operation and promotion.

Our Content: Platform design, features, and trademarks are our property. No license is granted except for using the Services under these Terms.

Content Removal: We may remove any Content (for violations, legal reasons, or at our discretion). No obligation to monitor.

9. Intellectual Property

The Platform, design, software, logos, and trademarks are our property. You may not copy, modify, reverse-engineer, or create derivative works without written consent.

10. Disclaimers of Warranty

The Services are provided "AS IS." No warranties—express or implied—of merchantability, fitness, security, availability, or results.

We do not guarantee:

  • Organizer/user reliability, backgrounds, or intentions.
  • Event safety, quality, or legal compliance.
  • Platform availability, accuracy, or error-free operation.
  • Specific results from using the Platform.
  • Compliance with event size restrictions or speed-dating bans.

You assume all risks related to Platform use and event participation.

11. Limitation of Liability

To the fullest extent permitted by law:

  • No liability for indirect, consequential, punitive, or special damages (e.g., lost profits, emotional distress, injury, property damage).
  • Direct liability capped at 100 CHF.
  • Excludes user conduct, events, offline harm, or violations of event size/type restrictions.
  • Some jurisdictions do not allow liability limitations—this applies to the maximum extent permitted.

Note for French Users: Under French Consumer Code, nothing in these Terms limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded or limited under French law.

12. Indemnification

You indemnify and hold harmless Migamor GmbH, its affiliates, directors, employees, and agents from all claims, losses, damages, liabilities, and costs (including legal fees) arising from:

  • Your use of the Platform or Services.
  • Your Content or conduct.
  • Your violation of these Terms or laws.
  • Events you organize or attend.
  • Any injury, harm, or damage during events.
  • Events exceeding size limits or speed-dating violations.

13. Termination

You: Delete your account anytime via account settings (data retained per Section 5).

We: Suspend/terminate accounts anytime for:

  • Violations of these Terms.
  • Organizing events with >10 people.
  • Organizing speed-dating events.
  • Security issues or legal concerns.
  • Any reason at our discretion—no notice required.

Termination does not eliminate your obligations (indemnification, liability, data retention).

14. Governing Law and Disputes

Governing Law: Swiss law (excluding conflict-of-laws rules). Zurich courts have jurisdiction.

For French Residents: Under French consumer law, these Terms are also governed by French law where it provides greater protection. In disputes, French courts at your place of residence may have jurisdiction.

Dispute Resolution:

  1. Informal Resolution: Contact us first—good-faith negotiation for 14 days.
  2. Mediation: If unresolved, mediation in Zurich (costs shared). For French users: mediation also available in France via an approved consumer mediator.
  3. Binding Arbitration: If mediation fails—Swiss Rules of International Arbitration, Zurich venue, single arbitrator, English language. Final/binding decision.
    • No Class Actions: Disputes resolved individually only—no class/collective/representative actions, jury trials, or group arbitrations.

For French Consumers: You retain the right to bring claims in French courts and use consumer mediation under Articles L.611-1 et seq. of the French Consumer Code. Mediator contact details available upon request.

15. General Provisions

  • Force Majeure: We are not liable for failures due to uncontrollable events (natural disasters, wars, pandemics, infrastructure failures).
  • No Third-Party Beneficiaries: These Terms are solely between you and us.
  • Assignment: We may assign/transfer these Terms; you may not without our written consent.
  • Amendments: We may update these Terms anytime. Notification via email/Platform. Continued use = acceptance. Major changes: 30-day notice.
  • Severability: Invalid provisions do not affect the rest of the Terms.
  • Waiver: Our failure to enforce does not waive rights.
  • Survival: Sections on liability, indemnification, IP, data, and dispute resolution survive termination.
  • Entire Agreement: These Terms (plus Privacy Policy) are the entire agreement—supersede all prior agreements.

17. Acceptance of Terms

By creating an account, accessing, or using Migavibe, you acknowledge that you:

  • Are at least 18 years old.
  • Have the legal capacity to enter binding contracts.
  • Have read, understood, and accepted these Terms.
  • Understand Migavibe is designed for heterosexual singles (partner platforms available).
  • Agree to organize/attend events with 10 people max only.
  • Understand speed-dating events are prohibited.
  • Assume all risks of offline interactions.
